Only Representative, OR and 3rd Party Representative:

Companies located outside of Turkey may appoint an OR to transfer KKDIK liabilities. In case an only representative is appointed, the only representative is responsible for fulfilling the obligations under this Regulation.

The only representative must have sufficient knowledge of the substance and its use and, without prejudice to the provisions of Article 32, must keep updated information on the quantities imported and the customers sold, as well as the provision of the latest update of the safety data sheet referred to in Article 27.

In case of appointment of an OR in accordance with the first and second paragraphs, the manufacturer shall inform importers  in the supply chain. Under the provisions of this Regulation, these importers are considered as downstream users.

The manufacturer, importer or, where relevant, the downstream user, may appoint third-party representatives on issues related to compliance. In these case, the identity of the manufacturer, importer or downstream user who has appointed a third party representative is not disclosed to other manufacturers, importers and downstream users by the Ministry.
